Mengikut proses undang-undang Malaysia seperti berikut:<\/p>\n\n<ul class=\"wp-block-list\"><li>Aset dibekukan serta-merta apabila kematian<\/li><li>Tiada transaksi bank pada akaun si mati dibenarkan<\/li><\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-estate-administration-in-malaysia-for-death-without-a-will\">Pentadbiran Harta Pusaka di Malaysia untuk Kematian Tanpa Wasiat<\/h2>\n\n<ul class=\"wp-block-list\"><li>Kematian tanpa Wasiat<ul><li>Simati diisytiharkan Sebagai Intestate (Belum menyatakan secara sah bagaimana harta pusaka tersebut akan diagihkan)<\/li><li>Waris si mati perlu dikenal pasti dan ditakrifkan oleh Akta Pengagihan Malaysia.<\/li><li>Benefisiari undang-undang ini perlu bersetuju dengan siapa yang akan menjadi pentadbir harta pusaka.<\/li><li>Benefisiari undang-undang ini kemudiannya perlu mendapatkan peguam untuk mendapatkan Surat Pentadbiran daripada salah satu perkara berikut:<ul><li>Mahkamah Tinggi (Jika harta pusaka lebih daripada RM5 juta) atau<\/li><li>Pentadbir Tanah Daerah (Jika harta pusaka yang mempunyai sebahagian harta tak alih, kurang daripada RM5 juta atau aset alih kurang daripada RM600,000)<\/li><li>Amanah Raya Berhad (Jika estet yang boleh alih sepenuhnya, adalah kurang daripada RM600,000)<\/li><\/ul><\/li><li>Mohon Surat Kuasa<\/li><li>Dengan Surat Kuasa Mentadbir, Wasi
