Wasiat adalah dokumen yang mengarahkan kepada siapa yang akan menerima harta anda atas kematian anda dan melantik wakil undang-undang untuk melaksanakan kehendak anda.<\/p>\n\n<p>Satu lagi perbezaan antara perancangan wasiat dan amanah ialah wasiat melalui probate. Ini bermakna mahkamah mengawasi pentadbiran wasiat dan memastikan wasiat itu tepat dan aset atau harta akan diagihkan dengan cara yang si mati inginkan. Harta di bawah Amanah bukan milik Pemegang Amanah secara peribadi. Walaupun harta amanah itu didaftarkan atas nama Pemegang Amanah, ia tidak pernah menjadi sebahagian daripada harta Pemegang Amanah apabila dia meninggal dunia. Hanya benefisiari Amanah sahaja yang layak menerima Dana Amanah, bukannya benefisiari Pemegang Amanah sendiri.<\/p>\n\n<p>Secara amnya, amanah lebih mahal dan menggunakan lebih banyak masa, tetapi mereka boleh membenarkan benefisiari anda melangkau probate, yang merupakan proses undang-undang yang memakan masa yang melibatkan mahkamah memeriksa harta anda dan kadang-kadang menyimpan aset anda dari tangan waris anda selama berbulan-bulan. Sementara itu, wasiat lebih mudah untuk membuat dan meminda.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-establishing-a-trust\">Menubuhkan Amanah<\/h3>\n\n<p>Seperti wasiat, amanah juga menerangkan bagaimana aset seseorang akan diuruskan dan diagihkan selepas kematiannya. Beliau juga menamakan pemegang amanah untuk menguruskan amanah bagi manfaat benefisiari (atau waris berganda).<\/p>\n\n<p>Kepercayaan hidup adalah dalam tindakan sepanjang hayat settlor. Settlor boleh melantik dirinya sebagai pemegang amanah prasyarat supaya dia boleh menguruskan harta amanah itu sendiri. Jika dia memanggil dirinya seorang pemegang amanah, dia juga mesti melantik seorang pemegang amanah untuk menguruskan amanah dan mengagihkan asetnya selepas pemohon menjadi tidak berupaya atau mati.<\/p>\n\n<p>Amanah boleh dibatalkan boleh diubah pada bila-bila masa selagi settlor boleh berbuat demikian.
